Supreme Court Delivers Blow to 2nd Amendment

The Supreme Court has “stayed” a lower court order blocking the Biden administration’s rule on ghost guns until October 16.

This means Biden’s new gun restrictions are able to proceed.

Ghost guns are homemade firearms without serial numbers that cannot be tracked by law enforcement. (Trending: Famous Actor Attacks Trump Supporters)

The government argues that these guns should be regulated and require serial numbers.

However, a lower court found that the regulation violated existing law.

The Supreme Court’s order allows gun part manufacturers challenging the rule to file briefs by October 11 before the court acts on or before October 16.

U.S. Judge Reed O’Connor of the U.S. District Court for the Northern District of Texas issued an injunction after finding that the regulation violated existing law. (Trending: Disturbing Flag Found Near Massacre in Israel)

Judge O’Connor found that the restriction went beyond its statutory jurisdiction in regulating “partially manufactured firearm components, related firearm products, and other tools and materials.”

The Supreme Court ultimately allowed the government’s rule on ghost guns to remain in place while an appeal of the injunction proceeded in the 5th Circuit.

Four conservative justices dissented from the decision. This included Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh.

Two conservatives, Chief Justice John Roberts and Justice Amy Coney Barrett, joined the court’s three liberals, Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson, to allow the rule to remain in effect.
